General Terms and Conditions

Article 1 – Definitions

In these general terms and conditions, the following terms shall mean:

Nélaya: the company that rents and sells Moroccan lebssat, dresses, kaftans, takchitas, accessories and related products.

Customer: any natural person or legal entity who makes an appointment, rents, purchases or reserves a product, or uses Nélaya’s website or services.

Product: any item of clothing, accessory or other item offered by Nélaya for rental or sale.

Rental product: a product temporarily made available by Nélaya to the customer.

Rental period: the agreed period during which the customer may use the rental product.

Deposit: the amount paid by the customer as security for timely return and proper condition of the rental product.

Website: Nélaya’s website, social media, booking pages and other online channels.

Article 2 – Applicability

  1. These general terms and conditions apply to every use of Nélaya’s website, every appointment, reservation, rental, sale, quotation and agreement between Nélaya and the customer.
  2. By making an appointment, placing a reservation, renting or purchasing a product, the customer declares that they agree to these general terms and conditions.
  3. Deviations from these general terms and conditions are only valid if confirmed in writing by Nélaya.
  4. If one or more provisions of these general terms and conditions are found to be wholly or partially invalid, the remaining provisions shall remain fully in force.

Article 3 – Website and information

  1. Nélaya strives to present the information on the website as completely, up to date and accurately as possible.
  2. Images, colors, descriptions and sizes on the website or social media are indicative. Colors may differ due to lighting, photography or screen settings.
  3. Nélaya is not liable for obvious typographical errors, pricing errors or inaccuracies on the website, unless there is intent or gross negligence.
  4. Nélaya reserves the right to change the content of the website, prices, collections and availability at any time.

Article 4 – Appointments

  1. Appointments for fittings, advice, reservations, rentals or purchases can be made via the website, social media, by telephone, by email or through a booking system.
  2. An appointment is only final once it has been confirmed by Nélaya.
  3. The customer must arrive on time for the appointment. In case of late arrival, the appointment may be shortened or cancelled, without the customer being entitled to compensation.
  4. If the customer is unable to attend, the appointment must be cancelled or rescheduled as soon as possible.
  5. Nélaya reserves the right to refuse, reschedule or cancel appointments if this is necessary due to force majeure, illness, double booking, unforeseen circumstances or other reasonable business reasons.

Article 5 – Reservations

  1. A product can only be reserved if Nélaya has expressly confirmed the reservation.
  2. For a reservation, Nélaya may require a deposit, advance payment or full payment.
  3. A reservation is personal and may not be transferred to a third party without Nélaya’s permission.
  4. The customer is responsible for checking the correct date, size, model, color and rental period.
  5. Nélaya may refuse or cancel a reservation if the customer provides incorrect information, fails to meet payment obligations or has previously acted in violation of these terms.

Article 6 – Rental of lebssat and dresses

  1. Nélaya rents Moroccan lebssat, kaftans, takchitas, dresses and accessories for special occasions such as weddings, engagements, henna evenings, parties and photoshoots.
  2. The exact rental conditions, rental price, deposit, rental period and return date will be discussed and confirmed in advance.
  3. The customer receives the rental product in good, wearable and presentable condition.
  4. The customer must handle the rental product with care and use it only for its intended purpose.
  5. The rental product may not be washed, steamed, altered, adjusted, repaired, sublet or lent to third parties without prior written permission from Nélaya.
  6. It is not permitted to use perfume, make-up, self-tanner, henna, oil, glue, glitter, food, drinks or other substances in such a way that they may cause damage, stains or odors to the rental product.
  7. The customer is responsible for damage, loss, theft, disappearance, burn holes, tears, missing parts, stubborn stains, odor, make-up damage, henna stains, damage to embellishments and any other decrease in value of the rental product during the rental period.

Article 7 – Rental period and return

  1. The rental period is agreed and recorded in advance.
  2. The customer must return the rental product no later than the agreed return date and agreed time.
  3. In case of late return, Nélaya may charge additional costs per day or part of a day of delay.
  4. If the rental product is unavailable for a next customer due to late return, the customer is liable for the damage suffered by Nélaya as a result.
  5. The rental product must be returned complete, undamaged and with all accompanying parts, accessories, belts, scarves, veils, jewelry or packaging.
  6. Nélaya checks the rental product after return. Any damage or missing parts may be reported to the customer afterwards.

Article 8 – Deposit

  1. For rentals, Nélaya may request a deposit.
  2. The deposit must be paid no later than when the rental product is collected, unless otherwise agreed.
  3. The deposit will be refunded after the rental product has been returned on time, complete and in good condition.
  4. Nélaya may deduct costs for damage, cleaning, repair, loss, late return or decrease in value from the deposit.
  5. If the damage exceeds the paid deposit, the customer remains obliged to pay the remaining amount to Nélaya.
  6. Refund of the deposit will take place within a reasonable period after inspection of the rental product.

Article 9 – Damage, loss and cleaning

  1. The customer is obliged to inform Nélaya immediately if the rental product is damaged, lost, stolen or heavily soiled.
  2. The customer may not repair damage or have damage repaired without Nélaya’s permission.
  3. If professional cleaning is required due to stains, odor, make-up, henna, smoke, food, drinks or other soiling, the cleaning costs shall be borne by the customer.
  4. If repair is not possible or the product can no longer be rented out, Nélaya may charge the customer the replacement value or current value.
  5. In case of loss, theft or complete damage, the customer is liable for the full replacement value of the product, including any accessories.

Article 10 – Sale of products

  1. Nélaya sells new or used lebssat, dresses, kaftans, takchitas, accessories and related products.
  2. Before purchase, the customer must check whether the product meets their wishes, size, color and condition.
  3. For sales in the boutique, exchanges or returns are only possible if Nélaya agrees, unless the law provides otherwise.
  4. Sale items, personalized products, hygiene-sensitive products, worn products and specially ordered or altered products cannot be exchanged or returned, insofar as legally permitted.
  5. If a product is specially custom-made, altered or personalized for the customer, the right of withdrawal may be limited or excluded. The Dutch government lists custom-made products, such as a tailored suit, as an example where the statutory cooling-off period for distance purchases does not apply.
